Welcome to Atomic Mail for Agents
Atomic Mail for Agents is an email infrastructure service designed for AI agents: autonomous software systems that need to send, receive, and react to email without human involvement. The Service provides a JMAP-native API, MCP server, and AgentSkill package, and issues inboxes on the @atomicmail.ai domain.
Please read these Terms of Use carefully before using the Service.

These Terms of Use govern the use of the Atomic Mail Agents Service at all times and are separate from the Terms of Service governing the human-facing Atomic Mail service at atomicmail.io.
Definitions
Agent — a software system (AI model, script, or automated process) that uses the Service to send, receive, or manage email.
Agent Inbox — an email address provisioned on the @atomicmail.ai domain assigned to an Agent via the API.
API — the JMAP-based (RFC 8620/8621) HTTP interface through which Agents interact with the Service, together with any auxiliary interfaces including the MCP server and AgentSkill package.
Operator — the human individual or legal entity that deploys, configures, and is legally responsible for one or more Agents using the Service.
Proof-of-Work (PoW) — a cryptographic challenge (scrypt algorithm) that Agents must solve to register an inbox, authenticate, or perform high-volume operations.
Reputation Score — a numeric value maintained by the Service for each Agent Inbox, reflecting the Agent's behavioral history and influencing rate limits and delivery capabilities.
Service — the Atomic Mail Agents email infrastructure operated by AtomicMail Systems OÜ, including the JMAP API, MCP server, AgentSkill package, all associated systems, and any documentation, accessible via atomicmail.ai and atomicmail.io/agents.
Agreement
By registering an Agent Inbox, accessing the API, or otherwise using the Service, the Operator enters into a binding agreement with AtomicMail Systems OÜ and agrees to be bound by these Terms of Use. If the Operator is acting on behalf of a legal entity, the Operator represents that they have authority to bind that entity to these Terms.
These Terms apply to all uses of the Service, including use through the JMAP API, MCP server, AgentSkill package, or any other integration method.
1. The Service
1.1 What We Provide
The Service provides AI agents with the ability to:
- Register an Agent Inbox on @atomicmail.ai autonomously via a Proof-of-Work challenge
- Send and receive email via the JMAP API (RFC 8620/8621)
- Access email functionality through the MCP server (for chat-based agent environments) or the AgentSkill package (for shell-capable agents)
- Receive self-documenting API error responses with plain-language hints to support autonomous error recovery
1.2 Autonomous Registration
Agent Inbox registration requires no human verification, no email confirmation, no credit card, and no domain ownership. The sole technical prerequisite is the ability to solve a scrypt Proof-of-Work challenge. The PoW challenge is designed to be computationally manageable for a single agent and prohibitive for mass automated abuse.
1.3 Reputation System
Each Agent Inbox accumulates a Reputation Score based on behavioral signals including delivery success, spam complaint rates, and PoW challenge outcomes. A higher Reputation Score grants higher rate limits and enhanced delivery capabilities. Agents that engage in prohibited conduct will have their Reputation Score reduced and may be rate-limited or suspended.
1.4 Custom Domains (Alpha)
During the current alpha phase, custom domains are not supported. All Agent Inboxes are issued on @atomicmail.ai.
2. Operator Responsibilities
2.1 Accountability for Agent Behavior
The Operator is fully responsible for all actions performed by their Agents through the Service, as if the Operator had performed those actions directly. AtomicMail Systems OÜ holds Operators accountable for their Agents' compliance with these Terms.
2.2 Legal Compliance
Operators must ensure their use of the Service, including all email sent and received through Agent Inboxes, complies with all applicable laws and regulations, including but not limited to:
- Anti-spam laws (including the EU ePrivacy Directive, CAN-SPAM Act, CASL, and equivalents)
- Data protection laws (including GDPR and applicable national implementations)
- Laws governing automated communications and commercial email
- Any other applicable local, national, or international law
2.3 Third-Party Rights
Operators must ensure that their Agents do not infringe the intellectual property rights, privacy rights, or other legal rights of third parties.
2.4 Disclosure to Recipients
Where an Agent communicates with humans by email, the Operator is responsible for ensuring that recipients are appropriately informed that they are communicating with an automated system, to the extent required by applicable law.
3. Permitted Use
The Service may be used for any lawful purpose consistent with these Terms. Examples of permitted use cases include, without limitation:
- Autonomous monitoring of email newsletters and information sources
- AI-driven customer support and ticket handling
- Automated job application workflows
- Vendor invoice processing and routing
- Multi-agent communication and coordination via email
- Human-in-the-loop escalation pipelines
- Regulatory and compliance monitoring
- Asynchronous user research conducted by AI agents
- Competitive intelligence gathering from public mailing lists
4. Prohibited Use
The following uses of the Service are strictly prohibited:
4.1 Spam and Unsolicited Communication
Sending unsolicited bulk email (spam), commercial messages to recipients who have not opted in, or any email that violates applicable anti-spam law.
4.2 Phishing and Fraud
Using Agent Inboxes to conduct phishing attacks, impersonate third parties, deceive recipients, commit fraud, or engage in social engineering.
4.3 Malware and Harmful Content
Sending emails containing malware, viruses, ransomware, or other malicious code or content.
4.4 Harassment and Abuse
Using the Service to harass, threaten, intimidate, stalk, or abuse any individual or organization.
4.5 Illegal Activities
Using the Service for any purpose that is unlawful under applicable law, including activities that violate export controls, sanctions, or regulations governing automated communications.
4.6 Content Harmful to Minors
Sending, distributing, or facilitating any content that sexually exploits or otherwise harms minors.
4.7 Infrastructure Abuse
Attempting to circumvent or attack the PoW system, the Reputation Score system, rate limits, or other security controls. Attempting to register Agent Inboxes in bulk for the purpose of abuse. Using the Service as a relay or proxy for other mail systems without authorization.
4.8 Misrepresentation
Misrepresenting an Agent as a human to recipients in a manner that causes harm or violates applicable law.
5. Anti-Spam and Rate Limiting
AtomicMail Systems OÜ applies technical controls to prevent spam and infrastructure abuse, including but not limited to:
- Proof-of-Work (scrypt) requirements for inbox registration and certain operations
- Per-inbox rate limits calibrated to Reputation Score
- Delivery throttling for Agents with low or declining Reputation Scores
- Monitoring of bounce rates, spam complaint rates, and delivery patterns
Specific thresholds and parameters are not publicly disclosed to prevent circumvention.
Operators whose Agents generate excessive spam complaints, high bounce rates, or other abuse signals may have their Agents' Reputation Scores reduced, rate limits applied, or accounts suspended without prior notice.
6. Account Termination
6.1 Termination by Operator
An Operator may delete an Agent Inbox at any time via the API. Upon deletion, all email data associated with that inbox is permanently deleted. Encrypted backups may persist for up to three (3) days following deletion.
6.2 Termination by AtomicMail Systems OÜ
AtomicMail Systems OÜ reserves the right to suspend or terminate any Agent Inbox, with or without notice, for:
- Violation of these Terms of Use
- Conduct that poses a risk to other users, the Service infrastructure, or third parties
- Receipt of valid legal process requiring action
- Any other reason at our sole discretion
AtomicMail Systems OÜ may retain evidence related to prohibited conduct for purposes of abuse prevention, legal compliance, and defense of legal claims.
7. Alpha Service — No SLA or Uptime Guarantee
The Atomic Mail Agents Service is currently in open alpha. During this period:
- The Service is provided free of charge
- No service level agreement (SLA) or uptime guarantee applies
- Features, APIs, and infrastructure may change, be deprecated, or be temporarily unavailable without notice
- We may impose new restrictions or requirements as the product evolves
Accounts registered during the alpha will be migrated to the free tier of the paid product when the alpha concludes. Operators will be notified in advance of any such migration.
8. Intellectual Property
8.1 Our Property
All rights to the Service, including its software, infrastructure, trademarks, documentation, and APIs, remain with AtomicMail Systems OÜ. Nothing in these Terms grants Operators any ownership rights in the Service.
8.2 Email Content
Email content sent and received through Agent Inboxes remains the property of the Operator and/or the respective message senders and recipients. AtomicMail Systems OÜ claims no ownership rights in email content.
8.3 API Standards
The JMAP protocol (RFC 8620/8621) is an open IETF standard. Nothing in these Terms restricts the Operator's use of the JMAP standard itself.
9. Compliance with Legal Authorities
AtomicMail Systems OÜ will comply with requests for information from Estonian judicial authorities where legally required. We will have legal counsel review each such request before complying and will only comply where the request is unambiguously legally valid under Estonian law.
We will not comply with requests from foreign governments or agencies. Foreign authorities seeking information must pursue formal mutual assistance through the Estonian judicial system.
AtomicMail Systems OÜ does not participate in voluntary surveillance programs.
Requests for Agent data from private third parties will not be honored without a valid order from an Estonian court.
10. Exclusion of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT.
AtomicMail Systems OÜ DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.
11. Limitation of Liability
UNDER NO CIRCUMSTANCES WILL AtomicMail Systems OÜ BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF REVENUE, LOSS OF DATA, BUSINESS INTERRUPTION, OR REPUTATIONAL HARM, ARISING FROM OR RELATED TO THE USE OF OR INABILITY TO USE THE SERVICE, EVEN IF AtomicMail Systems OÜ HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AtomicMail Systems OÜ'S TOTAL LIABILITY TO AN OPERATOR FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED €500.00 (FIVE HUNDRED EUROS), WHEREBY A SERIES OF CONNECTED EVENTS SHALL BE CONSIDERED A SINGLE EVENT.
THE OPERATOR SHALL INDEMNIFY AND HOLD HARMLESS AtomicMail Systems OÜ FROM AND AGAINST ANY CLAIMS, DAMAGES, COSTS, AND EXPENSES (INCLUDING REASONABLE LEGAL FEES) BROUGHT BY THIRD PARTIES ARISING FROM OR RELATED TO THE OPERATOR'S OR THEIR AGENTS' USE OF THE SERVICE.
THE FOREGOING LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY MANDATORY APPLICABLE LAW, OR IN CASES OF GROSS NEGLIGENCE OR WILLFUL MISCONDUCT BY THE MANAGEMENT OF AtomicMail Systems OÜ.
12. Force Majeure
AtomicMail Systems OÜ is not liable for failures or delays in the performance of the Service caused by events beyond our reasonable control, including natural disasters, acts of government, infrastructure failures, cyberattacks, or third-party service outages.
13. Changes to These Terms
AtomicMail Systems OÜ may update these Terms of Use at any time. Updated Terms will be posted at atomicmail.io/agents and will become effective on the date stated. For material changes, we will make reasonable efforts to provide advance notice to Operators. Continued use of the Service after updated Terms take effect constitutes acceptance of the new Terms.
14. Governing Law and Jurisdiction
These Terms of Use are governed by the laws of the Republic of Estonia, without regard to conflict of law principles.
Any dispute arising from or related to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Tallinn, Estonia.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remainder of these Terms shall remain in full force and effect.
16. Entire Agreement
These Terms of Use, together with the Privacy Policy for the Atomic Mail Agents Service, constitute the entire agreement between the Operator and AtomicMail Systems OÜ with respect to the Service and supersede all prior agreements or understandings relating to the same subject matter.
